Paternalism has attracted new defenders in recent years. Such defenders typically either downplay the normative significance of autonomy or deny that we are sufficiently rational for paternalistic interventions to be objectionable.1 Both of these argumentative strategies constitute challenges to John Stuart Mill’s influential anti-paternalistic ‘harm principle’, which states that coercive interference with the liberty of competent adults is justifiable only if such interference prevents harm to non-consenting third parties (Mill, p. 23).2 In this journal, Wilkinson has provided a novel, provocative (...) defence of paternalism in the medical context—one that (provisionally) accepts rather than challenges Mill’s harm principle.3 Wilkinson’s argument is complex. But he begins with Parfit’s influential account of personal identity.4 According to Parfit, Alice at T1 can be the same person as Alice at T2, but the extent to which Alice at T1 and Alice at T2 are similar depends on the extent to which there are ‘chains’ of strong psychological connections between Alice at T1 and Alice at T2. Strong psychological connections, in turn, are mental states such as intentions or beliefs, or psychological traits. For example, if Alice at T2 remembers very little about herself the day before, and the day before that, all the way to Alice at T1, Alice at T2 has completely different psychological traits than Alice at T1—for example, Alice at T1 was courageous, whereas Alice at T2 is cowardly—then Alice at T1 and Alice at T2 are distinct persons. If the harm principle is correct and Alice is autonomous, it is permissible to interfere with Alice’s liberty only if it prevents harm to some non-consenting third party. But if we accept Parfit’s view on personal identity, then a novel defence of paternalistic intervention emerges: Alice at T2 may well be a distinct person from Alice at T1. So, …. (shrink)

IntroductionA symptom cluster is very common among oncological patients: cancer-related fatigue, emotional distress, sleep difficulties, pain, and cognitive difficulties. Clinical applications of interventions based on non-ordinary states of consciousness, mostly hypnosis and meditation, are starting to be investigated in oncology settings. They revealed encouraging results in terms of improvements of these symptoms. However, these studies often focused on breast cancer patients, with methodological limitations. Another non-ordinary state of consciousness may also have therapeutic applications in oncology: self-induced cognitive trance. It seems (...) to differ from hypnosis and meditation, as it involves the body more directly. Thus, investigating its clinical applications, along with hypnosis and meditation interventions, could improve available therapeutic options in oncology. This article details the study protocol of a preference-based longitudinal controlled superiority trial aiming to assess the effectiveness of 3 group interventions to improve oncological patients’ quality of life, and more specifically CRF, emotional distress, sleep, pain, and cognitive difficulties.Methods and analysisA power analysis required a total sample of 160 patients. Main inclusion criteria are: cancer diagnosis, active treatments completed for less than a year, no practice of hypnosis, meditation, or SICT, and presence of at least one of these four symptoms: fatigue, sleep difficulties, depression, or anxiety. Each participant will choose the intervention in which they want to participate. To test the effectiveness of the interventions, data will be collected by questionnaires and neurobiological measures and directly from the medical record at four time points: before inclusion in the study ; immediately after the intervention; and at 3- and 12-month follow-up. The longitudinal data in each group will then be measured.DiscussionIn addition to standard cancer therapies, there is a growing interest from patients in complementary approaches, such as hypnosis, meditation, and SICT. This paper focuses on segmenting digital movie and TV series pirates and on investigating the effectiveness of piracy-combatting measures i.e., legal and educational strategies, in light of these segments. To address these research objectives, two online studies were conducted. First, 1277 valid responses were gathered with an online survey. Four pirate segments were found based on differing combinations of attitude toward piracy, ethical evaluation of piracy and feelings of guilt. The anti-pirate, conflicted pirate, cavalier pirate, and die-hard pirate can be (...) placed on a continuum of increasing pirating frequency, subjective norm, pirating self-efficacy, habit, and decreasing in perceived harm, respectively. The segments also differ in deontological and teleological orientations. Second, in an experimental mixed design, we find that the educational strategy is more effective than the legal strategy in lowering pirating intentions for the conflicted and cavalier pirate. However, both strategies fail at lowering intentions of the die-hard pirate, although perceived harm and perceived impunity were significantly influenced. These findings offer a more profound understanding of pirate segments and how they react differently to piracy-combatting measures. As a result, better strategies can be developed to control digital piracy. (shrink)

We have already had the occasion to study how Goldstein offered his fundamental postulates to neurorehabilitation, enabling it to establish itself as a new disciplinary branch of medicine [Gilart de Keranflec’h 2021]. Now we shall hypothesize that the proposals that Goldstein borrowed from his fellow contemporary neurologists by reformulating them, those he rejected and those he prolonged, were successive acculturations leading to a broader area than neurology alone, namely rehabilitative care. Long before he experienced exile —a major biographical turning point (...) in his life—had Goldstein not already led neurology down the path of exile, by demanding that it take into consideration its necessary hybridization with social and environmental issues? Combining dimensions of care, cures and even healing, rehabilitative care challenges the medical discipline alone for its pre-eminence over positive health outcomes for patients with health problems whose severity leaves them in a situation of disability. This interview study investigates the short- and long-term implications of incidental findings detected through brain imaging on research participants’ lives and their surroundings. For this study, nine participants of the Rotterdam Scan Study with an incidental finding were approached and interviewed. When examining research participants’ narratives on the impact of the disclosure of incidental findings, the authors identified five sets of tensions with regard to motivations for and expectations of research participation, preferences regarding disclosure, short- and long-term impacts and impacts (...) on self and others. The paper shows: that the impact of incidental findings may be greater than participants at first let on; incidental findings can have significant effects on participants’ social environment; and participants may not feel prepared for disclosure even if incidental findings have been discussed during the informed consent process. The authors call for investigators to be aware of research participants’ experiences and these short- and long-term impacts when designing suitable courses of action for the detection and management of incidental findings in research settings. Nurses mention the need for more palliative care training, their difficulties in taking a specific position, and their desire to express their ideas about euthanasia. There is a need to include nurses’ voices in the end-of-life discourse because they offer a contextual understanding of euthanasia and requests to die, which is borne out of real experience with people facing death. In this paper we present two compatible hypotheses to explain interest in celebrity gossip. The Learning Hypothesis explains interest in celebrity gossip as a by-product of an evolved mechanism useful for acquiring fitness-relevant survival information. The Parasocial Hypothesis sees celebrity gossip as a diversion of this mechanism, which leads individuals to misperceive celebrities as people who are part of their social network. Using two preliminary studies, we tested our predictions. In a survey with 838 respondents and in-depth interviews with 103 (...) individuals, we investigated how interest in celebrity gossip was related to several dimensions of the participants’ social lives. In support of the Learning Hypothesis, age proved to be a strong predictor of interest in celebrities. In partial support of the Parasocial Hypothesis, media exposure, but not social isolation, was a strong predictor of interest in celebrities. The preliminary results support both theories, indicate that across our life span celebrities move from being teachers to being friends, and open up a list of future research opportunities. (shrink)

Des droits fondamentaux au fondement du droit, le lien semble non seulement direct, mais évident. Or l'examen des différents discours théoriques sur le droit montre qu'il n'en est rien. Le livre de Charlotte Girard analyse précisément les différences de traitement du rapport entre ces deux termes dans les discours théoriques juridiques, en particulier ceux qui posent la question du fondement du droit. Soit l'étude des droits fondamentaux se distingue de celle du fondement du droit - les droits fondamentaux ne (...) mènent pas naturellement au fondement du droit -, soit on associe les deux notions - les droits fondamentaux sont au fondement même du droit. Or cette distinction renvoie à ce que la théorie du droit différencie traditionnellement : les approches juspositiviste d'une part et jusnaturaliste d'autre part. La confrontation de ces discours théoriques à la question du fondement du droit, qu'elle se traduise ou non par les droits fondamentaux, révèle une certaine fragilité des présupposés respectifs de ces discours. En réalité, le fondement du droit n'est pas seulement un élément de débat juridique et normatif, mais il relève aussi et surtout d'un débat politique et institutionnel. C'est en effet en raison de son caractère normatif que le fondement du droit - quel que soit le discours qui le porte, y compris le discours juridique théorique - appartient pleinement au champ politique. What determines if the first interaction between strangers will be a pleasant experience? We conducted an experiment to investigate the extent to which the perceived quality of an interaction is influenced by conversation content and context, and we document the physiological changes that are likely to play a role in establishing rapport. Females who did not know each other met in pairs and conducted a gossip- or creativity task, either face-to-face or online. The conversation content had no effect on the (...) quality of online interactions. However in the face-to-face condition gossip was associated with better interaction quality. Tonic electrodermal activity steadily declined throughout the interaction, while phasic electrodermal activity first peaked and then returned to baseline. Neither were related to perceived interaction quality. Heart rate variability dropped at first but then remained stable. A smaller drop in HRV drop corresponded to higher ratings of rapport and liking. Together these results suggest that gossip can improve the quality of a face-to-face interaction between strangers, and support the conjecture that parasympathetic activity is a marker of human openness to social engagement. Food media have become a formidable part of adolescents’ food environments. This study sought to explore how and why adolescents use food media by focusing on selectivity and motives for consumption. We conducted in-depth, semi-structured interviews with 31 Flemish adolescents aged 12 to 16. Food media were both incidentally consumed and selectively sought for education, social utility, and entertainment. The levels of selectivity and motives for consumption varied among the different food media platforms. Incidental consumption was more prevalent with TV (...) cooking shows compared to online food media. The dominant motives for TV cooking show consumption were companionship and entertainment, while online food media were used for a more diverse range of motives dominated by information/inspiration and social interaction. Some participants consumed food media to get motivation and inspiration to improve health and fitness while others consumed food media to watch appetizing and aesthetically pleasing food content. The social environment in the form of friends and family as well as existing food preferences were dominant psychosocial factors for both traditional and online food media use. Future research is warranted to explore how incidental exposure and the identified motives for use relate to food media effects. (shrink)

To commemorate 40 years since the founding of the Journal of Business Ethics, the editors in chief of the journal have invited the editors to provide commentaries on the future of business ethics. This essay comprises a selection of commentaries aimed at creating dialogue around the theme Ethics at the centre of global and local challenges. For much of the history of the Journal of Business Ethics, ethics was seen within the academy as a peripheral aspect of business. However, in (...) recent years, the stakes have risen dramatically, with global and local worlds destabilized by financial crisis, climate change, internet technologies and artificial intelligence, and global health crises. The authors of these commentaries address these grand challenges by placing business ethics at their centre. What if all grand challenges were framed as grand ethical challenges? Tanusree Jain, Arno Kourula and Suhaib Riaz posit that an ethical lens allows for a humble response, in which those with greater capacity take greater responsibility but remain inclusive and cognizant of different voices and experiences. Focussing on business ethics in connection to the grand challenge of environmental emergencies, Steffen Böhm introduces the deceptively simple yet radical position that business is nature, and nature is business. His quick but profound side-step from arguments against human–nature dualism to an ontological undoing of the business–nature dichotomy should have all business ethics scholars rethinking their “business and society” assumptions. Also, singularly concerned with the climate emergency, Boudewijn de Bruin posits a scenario where, 40 years from now, our field will be evaluated by its ability to have helped humanity emerge from this emergency. He contends that Milieudefensie v. Royal Dutch Shell illustrates how human rights take centre stage in climate change litigation, and how business ethics enters the courtroom. From a consumer ethics perspective, Deirdre Shaw, Michal Carrington and Louise Hassan argue that ecologically sustainable and socially just marketplace systems demand cultural change, a reconsideration of future interpretations of “consumer society”, a challenge to the dominant “growth logic” and stimulation of alternative ways to address our consumption needs. Still concerned with global issues, but turning attention to social inequalities, Nelarine Cornelius links the capability approach to global and corporate governance, arguing that CA will continue to lie at the foundation of human development policy, and, increasingly, CSR and corporate governance. Continuing debate on the grand challenges associated with justice and equality, Laurence Romani identifies a significant shift in the centrality of business ethics in debates on managing differences, positing that dialogue between diversity management and international management can ground future debate in business ethics. Finally, the essay concludes with a commentary by Charlotte Karam and Michelle Greenwood on the possibilities of feminist-inspired theories, methods, and positionality for many spheres of business ethics, not least stakeholder theory, to broaden and deepen its capacity for nuance, responsiveness, and transformation. In the words of our commentators, grand challenges must be addressed urgently, and the Journal of Business Ethics should be at the forefront of tackling them. (shrink)

This volume of essays, based on papers presented at The A.V. Dans un contexte d'enchevêtrement des systèmes normatifs et de pluralisme juridictionnel, la question de l'autorité de la jurisprudence est centrale. Tantôt abordée comme un instrument normatif, tantôt comme une donnée purement factuelle, elle est toujours une variable inconstante. Entre la thèse de "l'autorité de la chose interprétée" et le concept de "dialogue des juges", il est difficile de parvenir à une conception unanime de l'influence que produit la jurisprudence. La thèse défendue systématise cet effet en limitant l'analyse à ce que (...) prescrivent les énoncés normatifs en vigueur. Partant du principe de déterminisme textuel, les juridictions sont prioritairement contraintes par les énoncés dispositionnels dont elles doivent faire application. Une part d'indétermination résulte néanmoins des spécificités de chaque contentieux, attachées aux questions litigieuses dont les juridictions sont saisies. La systématisation de l'effet que produit la jurisprudence repose sur deux critères essentiels : les normes et leurs modalités d'application. Sur ces fondements, la thèse propose de démontrer que la jurisprudence a valeur de preuve. La présence des deux critères susmentionnés conditionne les relations que les juridictions entretiennent. La jurisprudence produit ainsi un effet corroboratif. Ce dernier désigne le processus factuel par lequel l'interprétation délivrée par une juridiction est utilisée à des fins probatoires par une autre juridiction, en raison de l'analogie qu'elle établit. Le critère de l'analogie, entendu comme la "ressemblance de rapports" normatifs et factuels existant entre deux ou plusieurs litiges, constitue le lien essentiel à la réalisation des relations jurisprudentielles. L'étude s'attache à illustrer ce processus dans les rapports d'influence interprétative qu'entretiennent cinq juridictions : la Cour de justice, la Cour européenne des droits de l'homme, le Conseil constitutionnel français, la Cour de cassation et le Conseil d'Etat. L'effet corroboratif de la jurisprudence fournit une grille de lecture des relations jurisprudentielles, excluant toutes considérations extra-juridiques. (shrink)

InThe Second Sex, Simone de Beauvoir argues that women are often complicit in reinforcing their own unfreedom. But why women become complicit remains an open question. The aim of this article is to offer a systematic analysis of complicity by focusing on the Heideggerian strands of Beauvoir's account. I begin by evaluating Susan James's interpretation of complicity qua republican freedom, which emphasizes the dependent situation of women as the primary cause of their complicity. I argue that James's analysis is compelling (...) as far as it goes, but that it implies complicity is the inevitable outcome of women's current existence and fails to adequately account for Beauvoir's claim that women actively embrace their own unfreedom. I then draw out the Heideggerian strands of Beauvoir's analysis, demonstrating how this enables us to systematize Beauvoir's account of women's oppressive situation with her claims regarding the active role women can play in reinforcing their own unfreedom. I argue that this approach preserves the strengths of the republican interpretation, but provides a better account of cases where complicity may not be inevitable and yet some women still act to reinforce rather than resist their own unfreedom. The philosophers conceive the perpetual as intermediate between time and eternity; according to masters of the school of Chartres, moreover, the world itself is perpetual. For the troubadour poets, the perpetual functions rhetorically. The moralist Marcabru treats the personified abstraction as perpetual, continuous in identity yet subject to change, thus achieving a satiric duality of vision. The love (...) poet Bernart de Ventadorn develops a "poetics of perpetuity", using the very tensions and instabilities of fin'amors to fashions ideal and endless courtly worlds. (shrink)

The central question of this paper is: are deterministic and indeterministic descriptions observationally equivalent in the sense that they give the same predictions? I tackle this question for measure-theoretic deterministic systems and stochastic processes, both of which are ubiquitous in science. I first show that for many measure-theoretic deterministic systems there is a stochastic process which is observationally equivalent to the deterministic system. Conversely, I show that for all stochastic processes there is a measure-theoretic deterministic system which is observationally equivalent (...) to the stochastic process. Still, one might guess that the measure-theoretic deterministic systems which are observationally equivalent to stochastic processes used in science do not include any deterministic systems used in science. I argue that this is not so because deterministic systems used in science even give rise to Bernoulli processes. Despite this, one might guess that measure-theoretic deterministic systems used in science cannot give the same predictions at every observation level as stochastic processes used in science. By proving results in ergodic theory, I show that also this guess is misguided: there are several deterministic systems used in science which give the same predictions at every observation level as Markov processes. All these results show that measure-theoretic deterministic systems and stochastic processes are observationally equivalent more often than one might perhaps expect. Furthermore, I criticise the claims of the previous philosophy papers Suppes (1993, 1999), Suppes and de Barros (1996) and Winnie (1998) on observational equivalence. (shrink)

By reading through key passages from Laws book 5, Republic book 9 and the Philebus, I try to assess the way Plato endeavours to demonstrate that the virtuous life is also happy and thereby pleasant. I investigate to what extent these texts put forward any specificity of the pleasures of being virtuous, and how far the account they provide harmonizes with Plato’s (...) general views about pleasure. A peine quelque années plus tard, l’œuvre de Engel constitue déjà un élargissement considérable de la problématique lessingienne, tout autant d’ailleurs qu’une remise en cause de certaines de ses prémisses : la sémiotique théâtrale ne peut-elle constituer une alternative à la scission sémiotique (...) des « arts du temps » et des « arts de l’espace » ? Plus spécifiquement, l’analyse sémiotique du geste sera pour Engel l’occasion de dégager deux notions singulièrement opératoires : « peinture » et « expression » (Malerei, Ausdruck) qui seront transposables dans une sémiotique esthétique générale. En effet, elles permettent à Engel est de dégager analogies fortes entre musique, poétique, gestuel, pour s’acheminer vers une sémiotique comparée dont la perspective est entièrement neuve. On en retracera les ressorts essentiels en mettant en lumière le rôle intermédiaire important dévolu d’une part au modèle rhétorique de l’éloquence, d’autre part à la fonction métaphorique – moteurs de la transposition d’une sémiotique du langage à celle d’un « langage du geste ». L’article examine le rôle de l’interprétation dans la compréhension du sens d’un énoncé, selon une perspective contextualiste. Dans l’héritage des travaux inauguraux de Frege, de Wittgenstein et d’Austin, les principaux représentants du contextualisme – Charles Travis par excellence – soutiennent que la compréhension des critères qui fixent le sens des énoncés requiert un ancrage en contexte. Ces critères tiennent lieu de standard de correction de l’application des propriétés sémantiques. Mais dire que l’application des propriétés sémantiques d’un énoncé requiert la compréhension (...) des critères qui sont discriminants dans un contexte, est-ce pour autant affirmer que le locuteur interprète librement quel critère est pertinent et donc qu’il peut interpréter différemment le sens d’un même énoncé qu’un autre locuteur qui est dans la même situation ? Le premier enjeu de l’article est de montrer, à l’encontre de toute conception relativiste de la compréhension, que les critères du sens sont normés de manière conventionnelle et donc, qu’en contexte, il n’y a jamais qu’une interprétation possible des critères. L’interprétation est imposée par le contexte qui la norme. Dans ces conditions, cela a-t-il un sens de parler d’interprétation du sens de l’énoncé ? Le deuxième objectif du texte est d’examiner si, localement, la compréhension des énoncés du langage ordinaire peut cependant tolérer une, et donc plusieurs interprétations. L’article distingue alors deux processus : l’interprétation des signes du langage qui se justifie dès lors que les signes en question sont ambigus et l’interprétation du sens de l’énoncé qui s’impose dans un cas bien circonscrit, en cas d’absence ou du moins de méconnaissance du contexte. Il distingue alors plusieurs concepts d’ « interprétation » : l’interprétation qui consiste à substituer un symbole par un autre pour traduire un énoncé ambigu en langage ordinaire et l’interprétation qui ne se surajoute pas à la compréhension mais qui n’est autre que le processus de donation de sens lui-même et dont l’enjeu est exclusivement clarificateur. Résumé La théorie ricœurienne de la triple mimèsis est susceptible de recevoir deux lectures différentes et exclusives l'une de l'autre. Soit l'on considère, en vertu du « caractère majeur de l'action d'être dès toujours symboliquement médiatisée », que notre praxis est ontologiquement structurée selon des schémas narratifs — mais cette conception essentialiste de l'action minore le rôle configurant de la mise en intrigue et affaiblit d'autant la thèse de Temps et Récit concernant la « force d'innovation de la composition poétique (...) » ; soit on considère l'action comme inanalysable en amont de la représentation narrative, qui seule est en mesure de définir sa sémantique, sa symbolique et sa temporalité. En privilégiant la seconde interprétation, nous tâchons de démontrer ici que l'oeuvre poétique n'a pas qu'une fonction de re figuration et fait plus que de suggérer au lecteur de « change[r] son agir » : l'action n'est humaine et n'est possible que d'être médiatisée par une voix narrative, toute narration créant sa propre référence mais aucune ne donnant accès à un univers référentiel préexistant qui serait ontologiquement signifiant. Cette contribution vise à étudier les effets que l’amour des richesses a sur le caractère moral et les relations sociales, depuis les descriptions qu’en donne Platon au livre VIII de la République à travers le portrait de l’homme oligarchique, jusqu’à la déclinaison des quatre formes de l’avarice dans le traité des Caractères de Théophraste, dans lequel l’argent et les échanges marchands constituent par ailleurs un thème récurrent et structurant. On remonte avec Platon aux sources psychologiques de l’amour des richesses avant (...) d’en développer les conséquences morales, et, avec Théophraste plus particulièrement, les conséquences sur les relations de l’individu aux autres.
